WORKERS’ COMPENSATION The purpose of the Maine Workers’ Compensation Act of 1992, found under Title 39-A of the Maine statutes, is to provide compensation for workers who have suffered loss of earning capacity because of work-related injuries. Though the workers compensation act was set up as a "no fault" act so that the employee is only required to prove that his injury was sustained arising out of, and in the course of, his employment, workers’ compensation litigation has become increasingly complicated and adversarial. Employer representation. For employers, we provide both legal representation and a continuing update service educating employers on the ever-changing statutory and case law in this area. Employee representation. In the early stages of a claim, if your employer begins paying benefits immediately, you may not need an attorney. However, if you want to settle your case for an amount representing the fair value of the case, or your employer contests your claim or threatens an early stoppage of the payments, representation by an attorney may be advisable. You may also still have an allowable lawsuit against a third-party who may have negligently contributed to, or caused, your injuries.
